Wendell Clark represents clients in the financial services, insurance and numerous other industries in a broad range of sophisticated, high-stakes commercial litigation, including contract, intellectual property and other disputes. Over his 40 years of practice, he has gained significant experience representing state agencies, commercial enterprises and other parties to government contracts, with a particular emphasis on procurement disputes, bid protests, breaches of contract, tax incentives and related matters.
Wendell has a clear-eyed view of the processes, priorities and leadership of agencies throughout Louisiana state government. He draws on his expansive network of current and former government officials to help clients understand and navigate complex procurement and contracting policies, rules and regulations; identify potential risks; prevent disputes; and develop effective strategies to resolve conflicts when they arise.
With decades of experience representing businesses and state agencies, Wendell is well positioned to help his clients and counterparties find common ground, with a focus on preserving key relationships where possible. When disputes cannot be resolved through negotiation, settlement or alternative-dispute resolution proceedings, he is a highly effective advocate in court, before administrative bodies and in appeals.
Among other Louisiana state agencies, Wendell has advised the Office of Group Benefits, Division of Administration, Department of Public Safety, the Department of Health and the Office of Technology Services in contract disputes, bid protests and other procurement matters with contractors and vendors. He represents the Louisiana Housing Corporation in cases involving state administration of federal funds for affordable housing and tax-credit projects, and currently represents the Commission of the Department of Insurance as liquidator of a failed casualty company, following recent hurricane-related losses.
Wendell has also represented a number of private clients in state procurement and regulatory matters. For example, he advises a company that owns and operates cellular towers regarding compliance with local government requirements, and has handled space rental contracts for major telecommunications companies. In the insurance sector, Wendell has advised clients on applications to the Department of Insurance for authority to conduct business in Louisiana, defended claims and conducted coverage analyses. Early in his career, he defended major automotive companies and other manufacturing clients in product liability and warranty cases.
